1. General provisions
“Confidentiality Regulations regarding the collection and processing of personal data” (hereinafter referred to as the Regulations) defines the principles and procedure for the actions of the RUSBAT Association, which is the organizer (operator) of events - exhibitions and conferences, information about which is provided on the website rusbat-expo.com and rusbat .com (hereinafter referred to as the Operator), in the field of collection, storage, processing and protection of personal data provided by users of this site.
Any subject of personal data has free access to this Regulation.
This Regulation has been developed in accordance with the Federal Laws “On Personal Data” dated July 27, 2006 N 152-FZ and “On Information, Information Technologies and Information Protection” dated July 27, 2006 N 149-FZ, the current legislation of the Russian Federation and has the status of a public offer .
All personal data received and processed by the Operator is confidential information (except for that specifically noted by the User or otherwise named in this provision), strictly protected in accordance with the law.
2. Definitions
In these Regulations, the terms established by No. 149-FZ and No. 152-FZ are used, as well as the following:
Registered user of the site – a site user who has passed registration, verified the provided data and received positive validation results in the form of feedback via the information channel specified by him.
Non-confidential data – part of the personal data authorized by the subject of personal data for distribution by indicating them on the event website in order to bring them to other registered users of the site.
Site user – a legal entity, individual entrepreneur or individual who intends to become a participant in events and subsequently receive information about him through the functionality of the site.
registration on the site – the procedure for the user to voluntarily enter the registration form data required to enter the event.
Subject of personal data – a natural person who is directly or indirectly identified or identifiable through personal data.
Event participant – a subject of personal data who has expressed a desire, on a voluntary or contractual basis, to participate in an event held by the organizer as an exhibitor, speaker, visitor or in any other role and who has provided a certain amount of information about himself.
Event co-organizer – organization (legal entity) carrying out activities to organize a specific event on the basis of an agreement on joint activities with the organizer and together with him. This agreement stipulates the obligations of the co-organizer to protect the personal data of event participants to the same extent as the organizer.
Depersonalization of personal data – actions as a result of which it is impossible to determine without the use of additional information the ownership of personal data to a specific User or other subject of personal data.
Processing of personal data – any action (operation) or set of actions (operations) performed using automation tools or without the use of such means with personal data, including collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, destruction of personal data.
Providing personal data – actions aimed at disclosing personal data to a certain person or a certain circle of persons.
Dissemination of personal data – any actions aimed at disclosing personal data to an indefinite number of persons (transfer of personal data) or to familiarize with personal data of an unlimited number of persons, including the publication of personal data in the media, posting in information and telecommunication networks or providing access to personal data to any -or in another way.
Cross-border transfer of personal data – transfer of personal data to the territory of a foreign state to an authority of a foreign state, a foreign individual or a foreign legal entity.
Deleting of personal data – any actions as a result of which personal data is irretrievably destroyed with the impossibility of further restoration of the content of personal data in the personal data information system and/or the physical media of personal data are destroyed.
3. Basic rights and obligations of the Operator
3.1. The operator has the right:
– receive reliable information containing personal data from the subject of personal data;
– in the event that the subject of personal data withdraws consent to the processing of personal data, as well as sends a request to stop processing personal data, the Operator has the right to continue processing personal data without the consent of the subject of personal data if there are grounds specified in the Law on Personal Data;
– independently determine the composition and list of measures necessary and sufficient to ensure the fulfillment of the obligations provided for by the Law on Personal Data and regulations adopted in accordance with it, unless otherwise provided by the Law on Personal Data or other federal laws.
3.2. The operator is obliged:
– provide the subject of personal data, at his request, with information regarding the processing of his personal data;
– organize the processing of personal data in the manner established by the current legislation of the Russian Federation;
– respond to requests and inquiries from personal data subjects and their legal representatives in accordance with the requirements of the Personal Data Law;
– report to the authorized body for the protection of the rights of personal data subjects, at the request of this body, the necessary information within 10 days from the date of receipt of such a request;
– publish or otherwise provide unrestricted access to this Policy regarding the processing of personal data;
– take legal, organizational and technical measures to protect personal data from unauthorized or accidental access, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other unlawful actions in relation to personal data;
– stop transfer (distribution, provision, access) of personal data, stop processing and destroy personal data in the manner and cases provided for by the Law on Personal Data;
– fulfill other duties provided for by the Personal Data Law.
4. Purpose of processing personal data
The purpose of processing personal data received by the Operator is:
- informing the User, the subject of personal data, about changes in the current agenda of events to which the site is dedicated;
- ensuring access of the User, the subject of personal data, to events, entry to which is carried out by prior registration;
- informing the User who is the subject of personal data about subsequent similar events in the future (if he specifically indicates this);
- informing other registered users of the site about the User who is the subject of personal data within the scope of non-confidential data noted by him during registration or by a separate written agreement, carried out to increase the efficiency of his interaction with participants of events during their holding.
The operator undertakes not to distribute personal data, nor provide it to third parties without the consent of the personal data subject and to use it exclusively for the purposes and scope established in this section, except for cases specifically provided for in the legislation of the Russian Federation.
5. Procedure for collecting, processing and storing personal data
The collection and processing of personal data of Site Users is carried out with the voluntary consent of the subject of personal data.
By providing his personal data to the Operator, the subject of personal data (User) agrees to the processing of his personal data by the Operator for the purposes specified in this provision.
The Operator may request the following personal data of the User:
- Full Name;
- contact details (telephone, email) (*);
- name of the organization, position held, contact details of the organization (website, if not available - phone number);
- range of professional interests, etc.
The fields marked (*) are required for registration, the rest are optional, however, the Operator has the right to contact a potential participant through the communication channels specified by him for clarification and refuse him registration for events if there are doubts about his business or other reputation.
The processing of personal data is limited to achieving the purposes specified in these provisions.
When processing personal data, the Operator ensures the accuracy of personal data, its sufficiency, and, if necessary, relevance in relation to the purposes of processing personal data. The operator takes all necessary measures to ensure their acceptance, and if the inadequacy of the data in relation to the goals of the activities is obvious, then such data must be deleted.
Personal data is stored in a form that makes it possible to identify the subject of personal data, no longer than required for the purposes of processing personal data. The processed personal data is subject to destruction or depersonalization upon achievement of the processing goals or in the event of the loss of the need to achieve these goals (for example, if, upon receiving the newsletter, the subject refused to receive further information).
When processing personal data, the operator takes all necessary legal, organizational and technical measures or ensures their adoption to protect personal data from unauthorized or accidental access, destruction, modification, blocking, copying, provision, distribution of personal data, as well as from other unlawful actions regarding personal data.
6. Rights and obligations of personal data subjects
6.1. Subjects of personal data have the right:
– receive information regarding the processing of his personal data, except for cases provided for by federal laws. The information is provided to the subject of personal data by the Operator in an accessible form, and it should not contain personal data relating to other subjects of personal data, except in cases where there are legal grounds for the disclosure of such personal data. The list of information and the procedure for obtaining it is established by the Law on Personal Data;
– require the operator to clarify his personal data, block it or destroy it if the personal data is incomplete, outdated, inaccurate, illegally obtained or not necessary for the stated purpose of processing, as well as take measures provided by law to protect their rights;
– put forward the condition of prior consent when processing personal data in order to promote goods, works and services on the market;
– to withdraw consent to the processing of personal data, as well as to send a request to stop processing personal data;
– appeal to the authorized body for the protection of the rights of personal data subjects or in court against unlawful actions or inaction of the Operator when processing his personal data;
– to exercise other rights provided for by the legislation of the Russian Federation.
6.2. Субъекты персональных данных обязаны:
– provide the Operator with reliable information about yourself;
– inform the Operator about clarification (updating, changing) of your personal data.
Persons who provided the Operator with false information about themselves or information about another subject of personal data without the latter’s consent are liable in accordance with the legislation of the Russian Federation.
Refusal to register based on business or other reputation is unconditional and cannot be grounds for legal challenge.
7. Non-confidential information and grounds for refusal to participate in the event
Participation of the subject of personal data in the event held by the organizer named in section 1 means his unconditional consent to classify as non-confidential information any photo and video material containing a visual and audio image of the subject, captured by technical means of recording and transmitting photo and video information as the organizer or his authorized person, as well as any other participant in the event or third party. The organizer has the right to use the information obtained in this way to cover the event in the open public media space (photos, video reports, broadcast of the conference, including through Internet platforms) in any form, with the exception of forms that degrade human dignity in the generally accepted understanding of this concept in Russian society .
By expressing consent to his public speech (application for a report, fact of a report, speech, remarks from the floor), the subject grants the organizer the right to further use (accepts) all materials of his public speech used by the subject, both articulated and presented by him directly during the speech, and transmitted to the organizer before or after the event. The request of the personal data subject to limit subsequent access to his planned public performance is a basis that allows the organizer to refuse to provide him with the opportunity to speak.
8. Cross-border transfer of personal data
8.1. Before starting activities for the cross-border transfer of personal data, the operator is obliged to notify the authorized body for the protection of the rights of personal data subjects of its intention to carry out cross-border transfer of personal data (such notification is sent separately from the notification of the intention to process personal data).
8.2. Before submitting the above notification, the operator is obliged to obtain relevant information from the authorities of a foreign state, foreign individuals, foreign legal entities to whom the cross-border transfer of personal data is planned.
9. Confidentiality of personal data
The operator and other persons who have access to personal data are obliged not to disclose to third parties or distribute personal data without the consent of the subject of personal data, unless otherwise provided by federal law.
10. Final provisions
10.1. The User can receive any clarification on issues of interest regarding the processing of his personal data by contacting the Operator via email info@rusbat.com.
10.2. This document will reflect any changes to the Operator’s personal data processing policy. The policy is valid indefinitely until it is replaced by a new version.
